DuaLearn - Terms of Service

1. Acceptance of Terms

Welcome to DuaLearn! These Terms of Service ("Terms") govern your access to and use of the DuaLearn mobile application ("App," "Service," or "DuaLearn"). By downloading, installing, or using DuaLearn, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

2. Description of Service

DuaLearn is a mobile application designed to help users learn and memorize Islamic supplications (duas) through:

Interactive learning modules with audio, transliteration, and translations
Progress tracking and achievement systems
Quizzes and review features
Daily reminders and streak tracking
Multi-language support
Dhikr counter with daily challenges
Sleep mode for listening to duas
Accessibility features for users with different needs

3. Eligibility

DuaLearn is available to users of all ages. If you are under the age of 13 (or the applicable age of digital consent in your jurisdiction), you must have permission from a parent or legal guardian to use the App.

4. License and Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use DuaLearn for your personal, non-commercial use.

You May:

Use the App for personal learning and spiritual development
Share your experience and achievements with others
Customize your settings and preferences

You May Not:

Modify, reverse engineer, decompile, or disassemble the App
Remove or alter any copyright, trademark, or other proprietary notices
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the App or its related systems
Distribute, sell, sublicense, or commercially exploit the App without permission
Use automated systems or bots to interact with the App
Create derivative works based on the App
Copy, reproduce, or extract the source code

5. Intellectual Property Rights

DuaLearn contains a mix of original content, licensed content, and public domain religious texts:

5.1 Original Content (Our Intellectual Property)

The following are created by DuaLearn and are our intellectual property:

All translations of duas into English, Turkish, Dutch, and other languages
All transliterations of Arabic texts
The compilation and curation of duas
Graphics, illustrations, and visual designs
User interface design and software code
Logos and branding materials
The gamification system and learning algorithms

5.2 Licensed Content (Third-Party Sources)

The following content is sourced from third parties under their respective licenses:

Audio Recitations: Quran recitations by Yasser Al-Dosari, sourced from EveryAyah.com
Sound Effects: Sound effects sourced from freesound.org (special thanks to rhodesmas)

These third-party materials are used in accordance with their respective licenses and terms of use.

5.3 Public Domain Content

The Arabic texts of the duas are from Islamic tradition and are considered public domain religious texts.

Important: While the Arabic texts are public domain, our original translations, transliterations, and the overall compilation and presentation in this App are our intellectual property and may not be extracted or reproduced without permission.

Proprietary Software: DuaLearn is proprietary, closed-source software. The source code is confidential and protected. Any unauthorized access, reproduction, or distribution of the source code is strictly prohibited and may result in legal action.

6. User Responsibilities

As a user of DuaLearn, you agree to:

Use the App in accordance with these Terms and all applicable laws
Maintain the security of your device
Be responsible for all activity that occurs on your installation of the App
Treat the sacred Islamic content with appropriate respect
Not misuse the App in any way that could harm, disable, or impair the Service
Respect the intellectual property rights of DuaLearn

7. Religious Content Disclaimer

Important Notice: DuaLearn provides Islamic duas (supplications) for educational and spiritual purposes. While we strive for accuracy in all translations, transliterations, and audio recordings:

We encourage users to verify content with qualified Islamic scholars
Translations are provided for understanding and may not capture the full depth of the Arabic text
Different schools of Islamic thought may have varying interpretations
The App is not a substitute for learning from qualified teachers or scholars

8. No Account or Registration

DuaLearn does not require account creation or registration. All your progress and settings are stored locally on your device. You are responsible for:

Backing up your device if you wish to preserve your progress
Understanding that uninstalling the App will delete all local data
Device security to protect your data

9. Optional Support

DuaLearn is free to use with no advertisements or in-app purchases. If you wish to support the development of the app, you may do so through the optional PayPal donation link available in the app. This is entirely voluntary and does not affect your access to any features.

10. Notifications

DuaLearn offers optional notification features for reminders. By enabling notifications, you agree to receive local notifications from the App. You can disable notifications at any time through the App settings or your device settings.

11. Updates and Modifications

We reserve the right to:

Update, modify, or discontinue the App or any features at any time
Release new versions with improvements or bug fixes
Add or remove duas or content
Change the App's functionality or user interface
Add new features or services

We will make reasonable efforts to notify users of significant changes through in-app notifications or update notes. Some updates may be required for continued use of the App.

12. Fees and Payments

DuaLearn is free to download and use. There are no in-app purchases or subscriptions. The app may include an optional donation feature to support development, but this is entirely voluntary and does not unlock any additional features.

13. Disclaimers and Limitations of Liability

13.1 "As Is" Basis

DuaLearn is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy or reliability of content
Security against viruses or malware

13.2 Limitation of Liability

To the maximum extent permitted by law, DuaLearn, its developers, owners, and affiliates shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Device damage or data loss
Issues arising from your use or inability to use the App
Unauthorized access to your device or data
Errors, inaccuracies, or interruptions in the App

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid to us in the past 12 months (which is zero for a free app).

13.3 Educational Purpose

DuaLearn is intended for educational and spiritual development purposes. We make no guarantees regarding spiritual outcomes, memorization success, or any other results from using the App.

14. Indemnification

You agree to indemnify, defend, and hold harmless DuaLearn, its developers, owners, affiliates, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Your violation of applicable laws or regulations

15. Third-Party Links and Content

The App may contain links to third-party websites or resources (such as the PayPal donation page). We are not responsible for:

The availability, accuracy, or content of external sites or resources
The content, products, or services available from those resources
Privacy practices of third-party sites
Transactions you enter into with third parties

Your use of third-party resources is at your own risk and subject to their terms and conditions.

16. Termination

These Terms remain in effect until terminated by either party:

16.1 Termination by You

You may terminate your agreement with us at any time by:

Uninstalling the App from your device
Ceasing to use the App

16.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if:

You violate these Terms
You attempt to reverse engineer or hack the App
We discontinue the App
Required by law or court order

16.3 Effect of Termination

Upon termination:

All licenses granted to you will immediately cease
You must delete all copies of the App from your devices
Sections of these Terms that by their nature should survive will remain in effect
All data stored locally on your device will remain until you delete it

17. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

We will update the "Last Updated" date at the top
We may notify you through the App or other reasonable means
Your continued use after changes constitutes acceptance of the new Terms
If you do not agree to the modified Terms, you must stop using the App

Material changes will be communicated at least 30 days in advance when possible.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

18.1 Dispute Resolution Process

Any disputes arising from these Terms or your use of DuaLearn shall be resolved through:

Informal Resolution: Contact us at nuurcompass@gmail.com to attempt to resolve the dispute informally
Mediation: If informal resolution fails, disputes shall be submitted to mediation
Arbitration or Court: If mediation fails, disputes shall be resolved through binding arbitration or in the courts of the Netherlands

18.2 Class Action Waiver

To the extent permitted by law, any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

19. Export and Trade Controls

You agree to comply with all applicable export and import laws and regulations. You may not use or export the App in violation of any laws or regulations, including sanctions or embargoes.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DuaLearn regarding the use of the App and supersede all prior agreements, understandings, and communications.

22. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of DuaLearn.

23. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.
